Terms of Service

Welcome to Refleks. These Terms of Service ("Terms") govern your use of theRefleksAI website assistant service, including the dashboard, API, embeddable chat widget, and related software (collectively, the "Service").

Refleks is operated by Ebubekir Korkut, a sole proprietor based in Kosovo.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Refleks provides an AI-powered chat widget that website owners install on their websites. The Service reads authorized website pages, organizes that content for search, and uses an AI provider to answer visitor questions. Indexed customer content is the primary source for answers; supporting page links are shown when available.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must provide accurate, current, and complete information.

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

When you provide a website URL to the Service, you confirm and warrant that:

• You own the website or have obtained authorization from the website owner to crawl, index, and display its content through the Service.
• The website does not contain content that violates any applicable law or third-party rights.
• Your website's robots.txt does not explicitly prohibit crawling by the Service's user-agent.

The Service will only crawl pages on the same domain as the URL you provide. We do not crawl external links. You can request removal of any indexed page at any time.

You agree not to, and not to attempt to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Use the Service to index, store, or display content you do not have the right to use.
• Attempt to circumvent rate limits, authentication, or security measures.
• Use the Service to build a competing product or extract data for commercial purposes unrelated to your website.
• Submit personal data of children under 13 (or the applicable age of consent) through the chat widget without appropriate consent.
• Use the Service to generate answers regarding medical, legal, or financial advice without appropriate disclaimers on your website.
• Interfere with or disrupt the integrity or performance of the Service.

The chat widget generates answers using an AI model. While we implement safeguards, AI-generated responses may occasionally be inaccurate, incomplete, or inappropriate ("hallucinations").

You acknowledge that:

• AI responses are not reviewed by humans before delivery to visitors.
• You should review the system prompts and sample responses to ensure they meet your standards before deploying the widget.
• Refleks is not liable for damages arising from AI-generated content shown on your website.
• You should include your own disclaimer on your website regarding AI-generated responses.

The Service is offered on a subscription basis. All payments are processed securely by Paddle.com("Paddle"). Paddle acts as the merchant of record for all purchases. By subscribing, you also agree to Paddle's buyer terms and privacy notice.

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Prices shown on the pricing page are localized totals and include applicable taxes where displayed. Paddle confirms the final currency, tax treatment, and amount before payment at checkout.

We reserve the right to change prices upon 30 days' notice. Price changes do not affect your current billing period.

Our Refund Policyprovides a full-refund guarantee for a customer's first paid purchase when requested within 14 calendar days. You may meaningfully evaluate the Service during that window; eligibility is not tied to a page or message threshold. The one-time guarantee includes reasonable protections against repeated refund cycles, fraud, chargebacks, quota circumvention, and Terms violations, subject to mandatory consumer rights.

You may cancel your subscription at any time from the dashboard or by contacting support@refleks.dev.

Upon cancellation, your subscription will remain active until the end of the current billing period. No prorated refunds are issued for partial periods unless otherwise specified in our Refund Policy.

Cancelling a subscription does not automatically delete your account. You may keep using any features available to your resulting plan or delete the account from the dashboard after the paid subscription is fully cancelled. Data is then handled under the retention periods in our Privacy Policy.

Your use of the Service is subject to our Privacy Policy, which explains what data we collect, how we process it, and your rights.

We do not use customer content to train our own AI models. AI and embedding providers process the limited content needed to operate the Service under their applicable API terms, as described in our Privacy Policy.

Customers that process personal data through the Service may use the general Data Processing Addendumtemplate as a starting point for customer personal-data processing terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

We use reasonable efforts to maintain uptime, but the Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control (including third-party infrastructure and AI-provider dependencies).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REFLEKS AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

We may suspend or terminate your access to the Service if you violate these Terms, if your use poses a risk to the Service or other users, or as required by law. We will notify you when reasonably possible.

Upon termination, your right to use the Service ceases immediately. Account and service data will be deleted or retained according to our Privacy Policy, including any periods required for billing, security, backups, or legal compliance.

We may update these Terms from time to time. Material changes will be communicated via email or through the dashboard. Continued use of the Service after changes constitute acceptance of the updated Terms.

These Terms are governed by the laws applicable in Kosovo, without regard to conflict-of-law principles. Any mandatory consumer protections that apply in your country remain unaffected.

Refleks uses Paddle.comas its payment processor and merchant of record. Paddle handles all billing, invoicing, tax compliance, and payment processing. Buyer payments are also subject to Paddle's buyer terms and privacy notice.
