Welcome to Website AI Assistant. These Terms of Service ("Terms") govern your use of theWebsite AI AssistantAI website assistant service, including the dashboard, API, embeddable chat widget, and related software (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Website AI Assistantprovides an AI-powered chat widget that website owners install on their websites. The Service crawls the customer's website content, indexes it using vector embeddings, and serves answers to visitor questions through a large language model (MiMo or another configured provider), retrieving only from that customer's indexed content.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must provide accurate, current, and complete information.

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

When you provide a website URL to the Service, you confirm and warrant that:

• You own the website or have obtained authorization from the website owner to crawl, index, and display its content through the Service.
• The website does not contain content that violates any applicable law or third-party rights.
• Your website's robots.txt does not explicitly prohibit crawling by the Service's user-agent.

The Service will only crawl pages on the same domain as the URL you provide. We do not crawl external links. You can request removal of any indexed page at any time.

You agree not to, and not to attempt to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Use the Service to index, store, or display content you do not have the right to use.
• Attempt to circumvent rate limits, authentication, or security measures.
• Use the Service to build a competing product or extract data for commercial purposes unrelated to your website.
• Submit personal data of children under 13 (or the applicable age of consent) through the chat widget without appropriate consent.
• Use the Service to generate answers regarding medical, legal, or financial advice without appropriate disclaimers on your website.
• Interfere with or disrupt the integrity or performance of the Service.

The chat widget generates answers using a large language model (MiMo or another configured provider). While we implement safeguards, AI-generated responses may occasionally be inaccurate, incomplete, or inappropriate ("hallucinations").

You acknowledge that:

• AI responses are not reviewed by humans before delivery to visitors.
• You should review the system prompts and sample responses to ensure they meet your standards before deploying the widget.
• Website AI Assistant is not liable for damages arising from AI-generated content shown on your website.
• You should include your own disclaimer on your website regarding AI-generated responses.

The Service is offered on a subscription basis. All payments are processed securely by Paddle.com("Paddle"). Paddle acts as the merchant of record for all purchases. By subscribing, you agree to Paddle's terms and privacy policy in addition to these Terms.

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. Prices are listed on the pricing page and exclude applicable taxes, which will be calculated and displayed at checkout.

We reserve the right to change prices upon 30 days' notice. Price changes do not affect your current billing period.

You may cancel your subscription at any time from the dashboard or by contacting support@websiteaiassistant.com.

Upon cancellation, your subscription will remain active until the end of the current billing period. No prorated refunds are issued for partial periods unless otherwise specified in our Refund Policy.

Cancelling a subscription does not automatically delete your account. You may keep using any features available to your resulting plan or delete the account from the dashboard after the paid subscription is fully cancelled. Data is then handled under the retention periods in our Privacy Policy.

Your use of the Service is subject to our Privacy Policy, which explains what data we collect, how we process it, and your rights.

We do not train AI models on customer content. Your indexed website data is used solely to power your chat widget.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

We use reasonable efforts to maintain uptime, but the Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control (including third-party API dependencies such as MiMo and OpenAI).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBSITE AI ASSISTANT AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

We may suspend or terminate your access to the Service if you violate these Terms, if your use poses a risk to the Service or other users, or as required by law. We will notify you when reasonably possible.

Upon termination, your right to use the Service ceases immediately. Account and service data will be deleted or retained according to our Privacy Policy, including any periods required for billing, security, backups, or legal compliance.

We may update these Terms from time to time. Material changes will be communicated via email or through the dashboard. Continued use of the Service after changes constitute acceptance of the updated Terms.

These Terms shall be governed by the laws of the jurisdiction in which our registered entity is established, without regard to its conflict of law provisions.

Website AI Assistant uses Paddle.comas its payment processor and merchant of record. Paddle handles all billing, invoicing, tax compliance, and payment processing. All payments are subject to Paddle's terms and privacy policy.
